Arbitration, Conciliation and Mediation
Pádraig Murray has offered a dispute resolution service since 1976 when his name was added to the RIAI Arbitration Panel. In 2000, his name was included on the Law Society Panel. Initially he dealt solely with arbitrations however since conciliation became a mandatory feature of the RIAI Contract Forms he has also offered a conciliation service and on occasion a mediation service. He only deals with building industry disputes, including archtect/client disputes.
In all, he has handled up to a hundred disputes, a majority of which were arbitrations. In most cases he was nominated to act by the President of the RIAI or the President of the Law Society, but on a number of occasions he has been requested by the parties to a dispute to act as an agreed arbitrator/conciliator.
In the case of arbitrations, up to half were either withdrawn or were settled by the parties during the course of the arbitration, the remainder were concluded by an award.
In the case of conciliations a substantial majority resulted in an agreed resolution or in the acceptance of the recommendation. A small number proceeded to arbitration, usually because one party refused to engage in the conciliation process.
